Bill O’Connell and Katie Pratt of Wells Anderson & Race recently defended the former Sheriff of Fremont County and the Board of County Commissioners in a suit arising from the death of a pre-trial detainee in the County jail. After a 6-day jury trial in Federal District Court in Denver, the jury found in favor of both defendants and declined to award the Estate any damages. The medical staff who made decisions were not part of the suit having previously settled with the Estate. This was an important victory for law enforcement officers who must be able to rely on medical staff for medical decision-making.
