Mary Wells won a significant victory for Texas Instruments in a toxic tort case of first impression in Delaware. The Delaware Supreme Court affirmed the trial court’s dismissal of all claims against Texas Instruments in a case where a minor plaintiff claimed that he was born with birth defects as a result of his father’s alleged exposure to toxic chemicals at Texas Instruments prior to the time that the child was conceived. Chappell and Wells crafted a successful motion to dismiss for failure to state a claim, arguing that Texas Instruments owed no duty to the later born child of its employee, and that the claims were barred by the Texas Workers Compensation statute.
L. Michael Brooks, Jr. obtained summary judgment in favor of two insurance company defendants in a federal insurance-coverage action. The case arose out of complex environmental litigation that spawned claims against the attorney who brought the environmental lawsuit and the experts who assisted him in it.
Suanne Dell and Adam O’Brien received a defense verdict on all claims in a multi-week wrongful death trial. The Plaintiffs in the case were the surviving family members of an individual who died of carbon monoxide poisoning in his cabin in Park County, Colorado. Ms. Dell and Mr. O’Brien represented a company that sold a hearth heater, which allegedly produced the carbon monoxide.
David Mayhan and Paul Dinkelmeyer represented a framing contractor from whom a homeowners association sought over $3.4 million. After a two-week trial, the jury awarded only $9,535 against our client.
Cathy Greer and Bill O’Connell obtained dismissal of a lawsuit brought in state court by a sheriff’s deputy who was terminated by the sheriff after an incident involving a raid on a keg party in the mountains.
David Mayhan and Sarah Smyth O’Brien obtained a defense verdict for a target drywall subcontractor in a multi-million dollar arbitration alleging construction defects in a multi-family development.
In 2014, Sheryl Anderson defended three third party liability automobile cases, which resulted in successful jury verdicts for her clients.
Sheryl Anderson and her team obtained Orders granting Summary Judgment on behalf of her clients on the issue of the statute of limitation in two matters involving claims on an insurance policy, in 2015.
Sheryl Anderson represented an insurer as part of a group of defendants in a class action lawsuit who obtained an Order of Dismissal in a class action matter involving claims of homeowners for flood or fire damage benefits suing insurers and related organizations.
In November, 2015, Cathy Havener Greer and Rachel Entrican received an Order granting dismissal of a plaintiff’s complaint related to alleged violations of the plaintiff’s civil rights arising from the plaintiff’s exclusion from a college campus.
L. Michael Brooks and Rachel Entrican won summary judgment for an insurer against a collateral assignee bank claiming wrongful denial of life insurance benefits, in mid 2015.
After a five-day jury trial in federal court, David Mayhan and Rachel Entrican prevailed on behalf of an Eastern Plains town sued for breach of contract related to development of a rural airport, in which the plaintiff developer sought $7 million in damages and the jury awarded $1 (one dollar). In 2015 Sheryl Anderson provided an in-house presentation to an insurer client on 1st Party Claim Handling.
At the 2013 CDLA Annual Conference in Beaver Creek, Colorado, David Mayhan was a co-presenter on Technology in the Courtroom; and, Trial Success Stories: What Does (or Does Not) Work.
Wells, Anderson & Race, LLC attorneys will be presenting at the May 5, 2016, CLM Greater Denver Chapter Education Event. The program will examine the various types of claims made by Plaintiffs in personal injury and wrongful death cases and the various types of damages that may be claimed. The program will also focus on the role of damages experts in evaluating and responding to such claims.
On December 2, 2015, Wells, Anderson & Race attorneys presented on ethical issues implicated in waiver of the attorney-client privilege and work product doctrine to the Denver chapter of the Association of Corporate Counsel.
On October 2, 2015, Rachel Entrican moderated a roundtable discussion at the Faculty of Federal Advocates’ “The Forum: Life and Law,” in Denver, Colorado.
On July 22, 2015, Rachel Entrican presented at Colorado Legal Services’ annual meeting in Durango, Colorado on strategies for having difficult conversations with clients and colleagues.
