Congratulations to Cathy Havener Greer and Katie Pratt

Cathy Havener Greer and Katie Pratt recently won a motion to dismiss a case alleging violations of the Racketeer Influenced and Corrupt Organizations Act (“RICO”), the Colorado Organized Crime Control Act (“COCCA”), and federal civil rights claims.  Ms. Greer and Ms. Pratt argued that the complaint and two later amendments failed to state a claim for relief and that the issues were more properly addressed in an ongoing state court family law matter between the plaintiff and her ex-husband.  Judge Phillip A. Brimmer, Chief Judge of the United States District Court for the District of Colorado, agreed that the complaint failed to state a claim against the Town, the Police Chief, and the plaintiff’s former spouse and dismissed the action.  Claims against other defendants were subsequently voluntarily dismissed by the plaintiff.  Post-dismissal briefing and motions for attorneys’ fees remain pending.  See Carlson v.
